Personally I think the fact that all supermarkets have them but slightly different is unfair waitrose and sainsburys are very similar to Colin.

When I first saw the Aldi charity tweet I thought it was a good idea. Then I read M&S' and thought Yeah why not come up with your own ideas for cakes. A Kevin carrot cake would be really popular.

Theeen I saw another tweet where someone had pointed out M&S have a fake Walnut Whip and loads of other well known branded goods they've knocked off....

I'm totally fence sitting!

M&S are being unreasonable. They either don't agree with copying or they do.
They can't just punish aldi and they shouldn't sell their own copies of other brands.

I assume the argument is pretty much the face? Aldis does look almost exactly the same as m&s. Waitrose & sainsburys are slightly different.
Otherwise they are all chocolate covered Swiss rolls with sweets on top!

M&S are correct to protect their intellectual property - and they have not ruled out bring cases against the other supermarkets - Cuthbert was just deemed the most similar.

So it's not a case of M&S just having a big old strop - you trademark for a reason (which I know as I have a few trademarks ) and you're right to stop others stealing your intellectual property

Having said that though - I'm fond of Colin and I like Aldi's sass

M&S now just look ridiculous, ignoring Aldi's offer of joint fundraising for cancer charities and focusing on a bloody cake design.

Loads of people would have supported them working together, increasing profile and profits for both.

If its such an issue Marks should take it up with every other supermarket too, instead of writing bitchy passive-agressive responses. Or just such it up; as others have already mentioned, M&S produce bootleg copies of all sorts of products as a matter of course.

I think it was a bit tacky of Aldi to use charity to try and wriggle out of a possible intellectual property lawsuit. They do way too much ripping off other brands and I don't buy their wide eyed 'oh but what about CHARITY' for a second. Noone comes out of this well but M&S haven't done anything wrong that any other company wouldn't do.

Until this hit the news, I didn't actually know M&S was the original caterpillar cake maker. I love caterpillar cakes for kids birthdays as they are super nostalgic for me, surprised they only came out when I was 4, and not earlier. But I don't think I've ever actually bought a Colin because I prefer Clyde and Curly's face, and Tesco does a gluten free version which has been handy at kids parties as there has been a coeliac in both my children's classes. I think M&S are being unreasonable because they are only challenging Aldi and haven't challenged any of the other supermarket brands. As others have pointed out, M&S copy branded products too.

I also don't like the precedent that it sets that a business is above the law and can rip off whoever they like then cause a social media pile on to wreck their reputation and get off scot free. Aldi are not some sweet little underdog with a rogue sassy PR person.
