To answer a few questions from last thread...

We haven't any photos, that I am aware, of the woodland over past 10 years. If we do they will most likely be unidentifiable as our woodland anyway. But Google Maps/Earth has been something we have already looked at and it is pretty clear I think that there hasnt been any clearing since recently, especially from the road side view.

We havent been confrontational and havent ripped down the fences because we really didnt want to get prosecuted and as stated previously, this man is pretty intimidating. I wouldnt be surprised if he had a few mates that could back him up; I think that is why our other neighbours arent wanting to get involved now (or perhaps they really are just happy with the money offered and cant be bothered to be involved?).

There is no planning permission for the woodland - but if there was wouldnt the CF need to present us with a Notice and complete a certificate anyway?

Title information is all updated and correct but hadnt thought about contacting Land Reg ourselves direct about this. Tbh we have been rather reliant on Dad's our solicitor.

We have instructed our solicitor to respond accordingly to the letter stating that this is our land still and contest their claim etc.

OP Have you contacted the TPO officer at the local council? You need to do that to explain that someone has claimed your woodland and done this. Do you know what trees have gone? do you have a TPO map for your area?

TPO officers tend to be quite volitional, so do try. Your solicitor should also be checking the Land Registry. You should also be writing to the neighbours who were intimidated and asking them for any evidence.

OP - how did you find out that the neighbours had been physically intimidated? Just pondering that if the neighbours have put that in writing/text/email, if it goes to court this will be proof of unreasonable force

I can’t believe it’s so easy to go and steal someone’s land. Not everyone could then afford a solicitor to fight it.

They sound utterly dreadful, OP. I wish your wood was near me, I'd happily pop over there with the dog every few days and tell the CF that I have your permission to walk there. And if he dared to lay a finger on me, I'd be on to Mr Plod in a heartbeat.

I'm going through a transfer with the Land Registry at the moment - the amount of fuss transferring the jointly owned with my deceased ex-husband which was bought between us before we married, into my sole married name has been epic.

I would suggest you start with the Land Registry - I believe it is possible to put some kind of note on the file. Ask them for advice - I think this may be why they are offering you money - the LR might have told them to sod off!!

Bing maps has different aerial photos to Google, if that helps.

Also, I'm sure you are aware OP, but with Google Earth (not Maps) you can use a slider to look at older aerial footage so you can compare.

CF all over, its a shame the neighbours didn't stand with you and fight, but can understand if they are that close its intimidating for them.

I don't think the issue is chatting about it but that mnhq had already said they were happy it was for real. At least that's my memory from a previous discussion. And of course troll hunting in any form is frowned upon so always best to just avoid the subject.

Hmm, but there are posts still standing on the thread preceding this one - from months ago! - saying exactly what I just said - i.e. that The Other Poster Who Shall Not Be Named was not genuine. They even use the t-word.

I am faintly surprised that mine was deleted in a matter of seconds while those remain.

But whatevs, as I said I didn’t really mean to troll hunt. Just thought when discussing something so far in the past, it would be all right.

I think I referred to this under a previous nn on the first thread... but would be very happy to help organise CFFest II in Twittlebee Wood. It definitely helped @FuckYouChrisAndThatHorseYouCameInOn when she had such trouble getting back her own field from CF neighbours who'd left a couple of horses in it. If only by making her smile!

I have family who work In the land registry and they are very approachable. You can put a restriction on your register to prevent this and they will advise!

The first step in claiming adverse possession is showing proof that you have made all efforts to contact the landowner and have received no response.

They do not have a leg to stand on, get solicitor to instruct them to remove fences and advise they will be paying all your costs.
