To think a full refund should have been offered

I picked up cake today for DC birthday party - looked gorgeous but it stunk of smoke! The house smelled too but I thought maybe the cake would be okay - but when I checked at home it really smelt strongly.

I messaged the lady and said I thought the cake was wonderful looking but I wouldn't eat it or serve it because of the smell of stale smoke and asked for a refund also said happy to return the cake to her.

She has apologised and said no one smoked around the cake, she said she would refund my money minus the deposit.

Now, I am okay with this because actually I feel sorry for her, clearly she doesn't know how bad her house smells and then in turn the cake. But really I feel she should have offered a full refund.

Aibu to think this? Every time I look at the cake I feel sorry for her and then doubt my thought that she was being unreasonable to, one sell a cake like that and two that she should have offered a full refund.

I am out of pocket because I have lost the deposit and had to go to a supermarket and buy another cake.

That's vile, I would be annoyed. Didn't you notice when you picked it up/got it in the car that it smelled?

I think she should have given it all back yes.

It's not about the money to be honest it's just a bit cheeky not to offer I think.

I kept the cake because she didn't want it back.

I feel sad for her. She did a fab job of the cake.

Yes I smelt it in the car. But it was her partner that gave me the cake as she was out. I could have gone back but I was in such a rush trying to get back to sort the party out. So decided to send a message and offered to take the cake back after the party had finished

It's not the only thing that has gone wrong in respect of her birthday !

Trust me it did smell. Otherwise why would I have not had the cake? I had to rush to a super market and have the awkward conversation via message with her. I paid for a cake to be made for a reason.

Should we really have to stipulate that we don't want a cake being made in a smoky house and not smelling of smoke ??

It cost her time and money to make a cake that couldn't be used though.

I disagree. Surely a cake maker has pride in the taste of the cake and wants it to be enjoyed. Any cake makers on here disagree?

I think it is unreasonable for anyone to make and sell items that stink of smoke.

Doesn't matter if you're a professional or not, if you sell in a shop or through Facebook.

Items made for others should not stink of smoke. (Well, unless they pyrographs of course.)

Yuk. Id return cake and leave feedback. Sounds like she hasnt good a hygiene certificate. Yuk yuk yuk.

If she is running a business from home then surely the law about not smoking in the work place applies.

No, you shouldn’t have to stipulate that, it should be obvious. It’s part of basic food prep knowledge and she is going to lose customers rapidly if she allows it to carry on.
I went to an 18th party once in a normally non smoking household and food set out in a room where people were discouraged from smoking. We were offered some left over flan etc to take home and it reeked. Like eating from an ashtray, so even a small amount of drifting smoke can affect food.

My parents smoked like a chimney. I never recall eating nicotine tasting food when returning as an adult.
Who knew fondant had the same properties as clothes in the ability to pick up smells.

Even my car smelt - it was very strong

The thing is people who live in smoky places stop smelling it.
