Court order wording....

Posting for traffic.....

I am trying to follow the court order with abusive ex husband, we are currently in discussions regarding the summer holidays next year as we book the want to get things booked.

The court order states the first week starts on a Monday at 3pm, I get weeks 1, 3 and 5, he gets 2, 4 and 6.

The boys break up on Tuesday 24th July.

Where does week 1 start?

It depends when they go back, doesn't it? If you count from the following monday do they go back to school in week 6?

They go back Wednesday 5th September.

Last year they broke up on a Fri so. I suggested we do Fri to Fri etc. He didn't want to and insisted the Monday which made a mess of the whole summer as we both booked holidays Fri to Fri before the court order was issued.

If he insisted on Monday last year, just keep it to the Monday after they break up.

If you count from 30th then they go back to school 3 days into WK 6. If you count from the 23rd ie day before they finish then then they go back in WK 7.

What would the arrangements be for the week before / or WK 7 depending on which way you did it?
Which would work best for you. I think I would just pick one. Then email and say these are school hols so from order pattern will start on Mon 23rd/30th. Don't give h the option - let him object if he wants.

The issue is that when it suits he applies the order and when it doesn't he doesn't....

If he applies the order as Monday then he will will lose week 6. I would point that out to him and let him decide (with a deadline by which he tells you otherwise you decide.)

So if I ask for something different he says that's not what the order says.

This morning he told the boys on the phone he loved them more than a fat kid loves cake. They are doing anti bullying week and he's encouraging abusive intentions! Slightly off topic but this is the sort of person he is.

Not sure I agree with this. A court order can't legislate for every eventuality. I'd say week 1 starts on Mon 23July

The main issue I have is that he wants week 6 and the half week at the end so I won't see them before they go back to school. Same thing happened this year and the boys were really upset on their second morning going on because they hadn't seen me for 11 days. I've raised this and he's dismissed it.

You don't get a full week one but presumably you get an extra day(s) at the end? So ultimately you still end up with the same time.

Oh cross-post - no, week 7 should be split equally and if you start from the Tuesday, you get an extra day to make up for it.
