Am I a CF, or is my neighbour?

To get my bins round to the front they have to be brought round the back of my house. I have access rights over my two side neighbours drive, and a path that runs to my side entrance. One neighbour has grassed over the path, he's overly anal about his front lawn. He spends hours on it weekly, I've seen him trim the sides with scissors.

Here's the problem, the way the cars are parked I simply can't do the bins without running over his lawn (that used to be a path!) He's just had a massive go at me for "churning up his garden" and he ranted for nearly 5 minutes about how he was going to report me to my landlord for destroying his property. I told him I had a right to use a small strip, he told me I didn't. I said I'd double check and scarperd.

So am I a CF to keep using his lawn or is he a CF for basically cutting my access and shouting at me?

If the deeds state that you have access rights he’s the CF, if they don’t it’s you!

Print off the document re your access rights from the land registery, knock on his door and say "I have a legal right to access my property over this land and I will be doing so."

If you have access rights then you have access rights. He doesn’t have to like it but it doesn’t change it. Have the cars started parking differently recently or is that where they are supposed to park?

Why not just leave your bins out the front permanently? Most people do that here.

Because they aren't pretty and some areas don't let you do that.

So the orange is my path, by the garages it's gated off and that's mine only. Can't get the bins round the cars easily. The green is both ndn lawn, the first one has been grassed over the path.

Love the diagram! You need to see the deeds, speak to your Landlord. If he has grassed over the path that legally belongs to your landlord (or nice NDN?) speak to your landlord and have them deal with getting him to take it up or explaining the rights over the house.

I have to confess that I am disappointed in your diagram, but the standard here has been phenomenally high lately, so I could be being unfair.

If you have access rights, you have access rights. Him grassing over the path instead of just decorating the edges with silver bells and cockleshells and pretty maids all in a row does not negate your rights.

If you have access rights then it's tough luck for him, he shouldn't have grassed the path. By the looks of your diagram (well done love a diagram xx ) your nice neighbour must be having the same issue, what do they do?

Hmm, I'd say we definitely are.

I concur that if you have access rights it's tough about his grass and he was a fool not to check before he grassed it.

Who’s are the cars and can the cars not be moved to move the bins? If yours easy peasy, if they’re his then offer this as a compromise

I agree re: the diagram. A month ago, I would have been impressed at the clarity, but sadly you have been outdone by far superior diagrams lately.

I don't really know what to suggest re: bins though

If you have access rights, then you have access rights, and I would ensure I use them.

There’s a law that says that if no one uses the access bit then he can claim it ~ not sure how long it takes, some years, but this could be him starting.

Basically, if he didn’t want you messing his lawn then he should have left that bit as a path as the other neighbours have.

If it really is a right of way, then the fact he has grassed over the lawn has made it worse for himself. A path wouldn’t be churned over would it, and it probably why it was paved to start with. Get your evidence, and show him, and continue to drag the bins over the old grassed over path.

So does your nice next door neighbour have to do the same as you and go over the grassed path to take their bins out? If so I would speak to them and check they have the same on their deeds as you and go to him as a United front.

Get your landlord or letting agent to get a copy of the dead proving you have right of access and speak to him.

Rainbow, my neighbours actually stopped speaking to us when we left the bins out more than 2 days. On one occasion they actually pushed the bin up to the door so we couldn't get in or out without moving them! We have a similar set up to OP and have to move our bins round the back of 4 houses and down a step so it is a PITA but we still put them away in our own time.

The Landlord will be highly displeased if the NDN is trying to stop you using a legal right of way that belongs to his property.

I should get straight on to the landlord yourself.

I'd guess the following: the NDN thinks he will try to get you to not use the right of way, and has a good chance of success because he feels that as you are "only" the tenant and not the owner your rights to the property don't matter so much, plus he also believes you won't know the legal position as you are not the owner. Furthermore, he somehow sees the landlord as in some way your "boss" and thinks that dobbing you in to him will get you into trouble. He is hoping that his threat will make you comply with his demands. He is wrong of course, and hasn't thought it through nearly enough. The landlord will get very cross and hand him his arse.

Who do the cars belong to? If they're yours can't you just move them out of the way or ask the other neighbours to leave more room on bin night?
