To be annoyed with the shop?

OH bought me a SodaStream from The ***, (am i allowed to mention the shop?)

Got it home - excited, drank some of the samples, then OH noticed that the best before date was JULY!! (ie 3 months ago) I emailed SS and they were lovely and are sending out a new set, and were VERY quick

The ***, however, have sent me a stock reply

"As I hope you can appreciate, unfortunately I am unable to view the item in question; therefore I am unable to make a decision based on the comments stated in your email dated .

Therefore I can confirm that in order for this matter to be looked into further, you will need to return to your local store along with your proof of purchase and the product where your concerns will then be addressed with the Department Manager, so they are able to look into the matter for you.

I can confirm that we have Policies in place that our stores must abide by and the responsibility is that of store management to make any decision regarding a return, exchange, refund etc in accordance to our policies and if they do not feel the situation is compliant with our policies the request may be declined.

Please accept my apologies for any inconvenience this may have caused you, and I hope that you will continue to be a valued customer of The .

I think its a bit shy personally, and i am happy that SS sorted it out but would have expected something a bit better from The *

So the shop wants you to return the item to store for an exchange, but Soda Stream have already sorted it? Why did you bother contacting the manufacturer and the retailer?

What did you expect the shop to do? If they can't see the item and the best before date, then how can they decide what is an appropriate response?

It seems perfectly polite as a reply - "Bring it in and we'll talk about it"

The shop is well within its rights to ask for the proof of purchase and the faulty product back in exchange for non faulty products. This is standard.

Yanbu for being annoyed that they sold you out of date stuff but yabu to be annoyed at their response. It's perfectly reasonable for a shop to ask you to return an unsatisfactory product if you want a replacement.

I bought a load of those samples from The Range a while ago, all the boxes were reduced to £1 because they were just out of date. 12 months on we are still using them up.
None of us have died.

i just felt it was a stock standard reply - and they should maybe have put something about checking the other ones they are selling to ensure that no one else buys them - just a little bit of effort

I emailed both the stop and soda stream on the same message, as they both needed to know. One because they are selling out of date food stock, and the other because someone is selling out of date food stock with their name on

(i put the * in shitty as i am used to Digital Spy - until their admins got their panties in a twizzle because i had a second account, because i had forgotten i had one with the name i wanted, and then reregistered with a slightly different spelling, thinking someone else had the one i wanted...)

I dont live close enough to 'pop in' - its completely out of my area, and would involve petrol and parking and children and eurhg..

i'll just leave it though... as you guys seem to be in agreement :-)

no, it was more the 'we dont care' we're not going to check our other stock just in case - it was the fact it was literally a stock standard letter - ie we dont care

legally, your 'contract' is with the shop you bought it from, therefore you need to sort it with them - after all, it's hardly SodaStream's fault that the shop is selling out of date machines.

When they say they cannot look I to the matter further unless you take the items and proof of purchase in, I doubt this means they won't check their stock for any others that are out of date - I think they are saying that they can't do anything more about your specific case.

I would be very surprised if they didn't go and check their stock for any others that are out of date, so I woildnt worry any more about that.
