aibu to call the cops

I have had to call the cops because this horrible person upstairs to me keeps throwing her fag butts in my garden.She keeps on denying it and blaming the neighbours but it seems pretty obvious it is her who is doing this after months of anti social behaviour from her.The cops have told me to keep a diary and keep them posted with what is happening .The cops say this action is not breaking the law but anti social behaviour.I feel totally helpless with what i can do about this anti social behaviour and it's really getting me down.Landlord can't do anything and the cops came around and told everybody it must stop but pointed no fingers.Any ideas what i can do to stop this anti social behaviour please? (apart from what I have done and within the law?)

Tyler I don't really want to fight fire with fire but I have thought about posting them through her letterbox but i've decided two wrongs don't make a right but thanks for the input all the same

I have all sorts of dirt and yucky things blown into my garden, it's normal and I pick them up.

Tyler that is the problem I have not seen her throw them nor am I 100% sure it is her but i'm 99% sure it is her judging by all her other anti social behaviour

That's the thing though OP, you can't blame her for this just because of the other stuff she's done. It is more than likely her but until you know for sure....

Can you tell the ciggie brand from the dimps? Maybe you can catch her out through that. It could be an unusual brand none of your other neighbours smoke.

I'm not really sure what advice to give then.
Do as the police say and keep a log of the incidents.
If you fear for your safety or see any illegal activity then call the police.
The council is more appropriate for noise/rubbish complaints and they have more power to act.
Find out if you have a neighbourhood or community policing team. You might be able to make an appointment to speak to them and they will have more time to discuss things with you fully and explain the options available to you.
Mediation is one option, so that you can discuss things with your neighbour in a controlled setting and come to an agreement together about how best to live along side each other.
