TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

He is right, RCN weren't doing nothing. They were actively having meetings about how to thwart For Women Judgement.

NC - you like government had the benefit of the SC judgement itself. An unlawful practice had been adopted practice, an unlawful local practice, you were sitting on your hands, you the RCN.
NP- I disagree that the SWAG meeting was minuted.

NC at the time of SC judgement they suspended policies and withdrew back. No policy in the system at the time. I am suggesting there was no gov policy to revisit, what there was was a practice that had grown up seen at NHS Fife that was at detriment to all female staff.

That practice had crept in and you as a union did nothing about it.
NP - partnership happens at SWAG, do not agree RCN doing nothing. RCN suggested SWAG had a role to play.

NC - (refers to SWAG minutes) you note bullet point - any policies through programme board. But the problem is that not that there is a bad policy, there was no policy at SWAG level, not such policy that 'men who say they are women are women).

I wonder if he is one of the bro’s whose actions they complain about in that report about those running the RCN.

He comes across (to me anyway) as so disingenuous. People don’t normally life the rock to see what is under it, I suppose. He probably normally gets clean away with his line of ‘patter’, without having to really answer for his decisions and actions.

Ok, I’m a bit (well very) cross at all these bullshitters carelessly making decisions which really badly affects women. And this a Union which is supposed to defend their members! Well, get the memo. Women FO, we don’t care if you lose your job for thinking you have rights. That’ll learn ya.

NP - We raised it this way as this is normal process.
NC - page 427 your response to MG of 27 May, essentially saying what you've just said. The gist of that is that the scottish gov kicking this into the long grass and unions happy for this to happen.

'Ought to have known' is a slippery old fish. One can argue that everyone 'ought' to know. SP ought to have known, because she ought to have been told. Doesn't mean she was.

NC - how long would you expect that call to be NP about 30 minutes.
NC it was put to Ms Peggie and she thought it was more like 10 minutes. Those notes don't account for a 30 minute call

it's my belief that it would be further along in the process where more of the facts are known that SF would make a decision about legal support.
NC - SP said in evidence that she didn't know what GC was. She wasn't the expert was she? Not her to know her beliefs were protected in law?

NP - no but it would have been too early to bring legal referral
NP this was an enquiry, a brief call. SP made it clear she was going to be suspended. SF place to advise on that, and to meet and to formulate response. An initial call doesn't cover all that you describe

but not too fucking early to give Sandie reassurance that there was a legal way forward open to her if other routes were unsuccessful!!!!!!!!!
