teacher returning to work

meeting setup with head as he is leaving soon and dont want to negotiate returning with a strange new head. Started maternity leave in Jan and want to return on July 19th just before we break up on 21st. Partly because I need to be back on full pay in summer and also am a senco and I prepare booklet/info etc for staff over hols and need to get information and dont want to be doing work over summer for free.

Do you think this is acceptable/allowed and I am correct in thinking I will be back on full pay when get paid on 25th if I return on 19th?

Dh was a governor when our kids were at primary school and something similar happened. Teacher went off on ML in sept, intending to take the full year off. Cover teacher appointed as replacement- worked the whole year, including preparing kids for SATS, writing end of year reports etc and then the original teacher waltzed back in for the last week in July when it was all sports day, end of term fun and games etc

The school wanted to be able to pay the cover teacher over the summer as she had been brilliant, but couldn't afford it

All technically and legally ok but seems very unfair on small schools. I've heard of other schools where the teacher returns even earlier, say may or June, after all the exams are over so easiest time, and as the cover teacher has been appointed for the whole year, the original teacher doesn't even have a timetable to teach! Doesn't seem an efficient or fair way to go about things

I think you should feel ashamed of yourself. It's exactly situations like this which gives teachers a bad name.

Why does it give teachers a bad name? She's entitled maternity leave, same as any other worker. With other workers you accrue annual leave which you can tack onto the end of your mat leave at your full pay rate.

So she's going back after 6 months mat leave, then getting 6 weeks holiday. During this time she is going to be doing some of her work.

I had my mat leave and then 30 days of accrued holidays = 6 weeks.

It's slightly different because she's contracted to attend school for 195 term time days a year. Who wouldn't love a job for which I could accrue 30days holiday in 6 months?

The good news for her is that she can return on the first day of the summer holiday on full pay. As she's not contracted to work those days, she doesn't have to show up but she's likely to be working anyway as she has stated.

I am now in a situation where I have been covering a teacher on sick leave who was appointed to cover another teacher on mat leave, initially as a supply teacher but then given a contract expiring on return of post holder. Lo and behold this teacher decides she is well enough to return to work just before the summer hols! Despite working incredibly hard holding this post for eight months this teacher swans in and picks up three months of salary for less than six weeks work. I lose three months of pay as a result. When I had my first baby I returned to work in September as I felt it was ethically wrong to return in July and oust the teacher who had been teaching my classes for the previous six months. It seems I really am alone in my thinking here!! This must be happening so often and something should be done to protect the rights of the covering teacher ie. entitlement to payment over holiday periods or a cut off date to prevent teachers exploiting the system like this. Come on teachers - be honest - how many hours of work over the six week summer hols do you really put in !? Most teachers I know cram it all into the final week before returning...
