Holiday entitlement, bank holidays and the part-time worker

I work four days a week with Thursday as my usual day off.

This time around, both Christmas Day and New Year's Day fall on a Thursday so I feel as if I am in effect losing my day off in those weeks. However, I am being told by HR where I work that I am not entitled to take two other days off to compensate.

This means that I will have two fewer bank holidays in this holiday year than I would have been entitled to in the last holiday year.

That doesn't seem right to me. Any HR types able to explain?

I work p/t, I get a pro rata BH allowance added on to my annual leave, but have to take BH as annual leave if they fall on the days I would normally work. Thought this was how every one did it? (falls off chair at the thought of our HR dept getting something right )

I'm a HR Manager for a large company and deal with this sometimes.
What you would do to work out a part timers holiday entitlement is:

Take full time holiday per year
Add 8 statutory holidays per year
Take the total and pro rata it.

Example: Jo is full time and gets 25 days company holiday + 8 statutory days. This means that she gets 33 days total.
If she then wanted to work 3 days instead of 5 days, she would take 33 divided by 5, multiplied by 3 as her pro-rata allowance, or 19.8 days. We would round this up to 20.

If a Bank Holiday fell on a day she was at work then a day would be deducted off her 20 days entitlement. If a Bank Holiday fell on a day she was not working, she would not receive payment for this as it would be accounted for in her pro-rata total to be taken on another day.

Hope this helps. Max

Um, Max this thread is 18 months old, so the OP is unlikely to read it I'm afraid.

Depends what your contract/annual leave policy says Brookeie. What do they say about bank holidays and about their right to refuse holiday applications?

I work part-time - working Mon, Tues and Thurs. In a normal year fulltimers get 8 days pub hols. I get these prorata and added to my prorata annual leave. When Public hol falls on a Mon/Tues (which most do!) these just get taken off my annual allowance. I can't see the confusion? Yes - it means I have to take some of the phs as annual leave - but overall I still get my fair amount off.
