Redundancy advice needed

Hi

I have tried to ask chat GPT but could do with talking to people who have experience with this.

Will try to explain as clear as I can

There are 10 ABC Managers, all on grade 2.
These 10 ABC Managers are managed by 2 XYZ Managers who are both grade 3.

I am an ABC Manager.
In April, one of the XYZ Managers went on maternity leave. I applied for a 12 month secondment to the XYZ Manager role and I got it.
As an XYZ Manager, I report directly into Mr S

Last week, it was announced that the ABC Managers role was being put at risk. If agreed, there will be no ABC Managers going forward, and the leave date is 31st August.

I was part of the briefing, as my substantive role is the ABC Manager. I had the follow-up consultation 121 conversation with Mr S. This was before any official letters were shared.

In that meeting, Mr S said I had 2 options. That I could leave at the end of August as per the other ABC Managers, and receive pilon. Or I could stay in the seconded XYZ role until April 2027, receive redundancy at that point but receive no pilon.

I didn't indicate anything to Mr S about what I plan to do, however I think my preference is to go to in August..I've done more than 15 years and while I could stay until April and get paid for it, the job is going to be hell without the 9 ABC Managers, as the way it sounds, the work of the 9 ABC Managers will be done by the 2 XYZ Managers.

I then received my letter from HR. It has provided an indicative redundancy payment amount, however in the letter, it says that my end of employment date is 30 April 2027. There is no indication of a pilon payment.

If they have quoted April, does this mean that they expect me to be here until the end of April, and I wouldn't be allowed to decide to go in August instead? If they say that I can go in August, will it mean that they won't have to pay me pilon given the notice period is 6 months, and April is the original end date which means they have given me 6 months notice and it is my choice to end if early?

Ultimately I'm trying to understand is if they have me over a barrel with the secondment and I have to stay and see it through (which would help them immensely due to my experience as a top performing ABC Manager)

So you can go back to original abc and go in August which would give pilon tax relief
or stay till the end of secondment the revert back to abc in April and made redundant with immediate effect no pilion

I think they would as it would be unfair on others on your grade that are leaving
the big thing is treating everyone fairly and equally

There is no tax relief on PILON.

You need to pick a lane. Are you staying till April in the higher scale role and effectively working your notice or are you returning to the lower scale role and leaving in August with PILON? You can’t choose one and do the other.

notice pay doesn’t fall within the £30k tax free limit as it’s a contractual obligation. Her redundancy pay will fall within it

This. And it applies regardless of when it is paid.
