Redundancy 8 Months Pregnant - Due on Maternity in 2 Weeks

Hi All,

My company a large higher education provider in the UK has been in trouble for a while and hanging redundancies over our heads now for over a year, the whole thing has been terribly executed and has caused a rift within the whole company and teams, it's been a really unsettling time.

The last update we had in May was that nothing was being done as yet but the next update would be August - I have had an email this morning saying the sectors, roles and teams at risk will be outlined next week, its almost common knowledge that the sector I work within will be affected.

I'm 8 months pregnant and due to go on maternity in around 2 weeks, I have gone through all the legal company policies regarding my pregnancy and I have done everything correct, notifying them in time and providing MATB1 forms, having all my maternity meetings etc. The maternity package is good and pays 5 months full pay and then 4 months SMP. I meet all criteria for maternity pay.

HR have been useless and have just said they can't reassure me until the next update as they don't even know themselves. There is so much red tape with it being education as you can imagine, its been a really stressful time throughout my pregnancy with just the fear of the unknown.

There will still be a requirement for my role, whether that's in another capacity, another sector - they will just be reducing the amount of people, for example there is around 10 people that have my title in my sector spread across working on different projects and areas. Will I be protected and have to be offered one of these jobs? There is a lot of conflicting information.

I guess I will just have to wait and see what happens and whether my role is put at risk, but I can't see all this being wrapped up before I am due to go on Maternity.

Just looking for any tips and advise from anyone who's been in a similar boat

If they do make you redundant:

  • You will definitely be entitled to all of your SMP. They can pay anyout standing at your last date of employment in a lump sum.
  • You will be entitled to the occupational maternity pay top up until your last day of employment. They will have to give you at least statutory notice https://www.gov.uk/redundancy-your-rights/notice-periods.
  • you will accrue annual leave to your last date of employment and be paid for it.
WRT the job if they are redeploying into like for like roles you should be given priority for a post.
