Hi

I am asking this for a friend as I have had a few discussions with alot of different outcomes.

My friend has requested MARS however they have another job, can they still claim MARS if they have another position to go to. At the moment they are still working and are ion annual leave but once their annual leave is over they will be starting another job in August but they have requested for MARS, am I correct is saying they can not claim for MARS if they have another job to go into?

Can someone clarify as I have been told they can not claim MARS if they have another job?

Please can someone help?

It sounds about right. I have just taken it, and I leave in September. The agreement is that you can't have a job lined up before you sign the agreement and you can't come back to work at this place within a year. Depends on the individual organisation I guess. I'm leaving to pursue full time education but I didn't tell them. It would look dodgy if they wanted a reference I guess.

It's usually a requirement of the contact that you don't have another job to go to.

Ah ok so basically their manager said to them that they could not claim MARS if they have another job. They start next month. So basically to cut a long story short, they left the country they took a months annual leave and said they were going on holiday but they were actually moving abroad as they got another job out there and start next month. With this in mind they also said that they may not come back due to family issues but they knew they had another job lined up. They were told to request MARS which they did but after speaking to them they said now the manager has stated they cant claim MARS if they have another job lined up.

I said that they could have just said they were requesting MARS due to family circumstances but they have come back and said that they don't want to lie to their new job, which I find odd as how would the new job find out since they have left the country and references checks have been done?

Is this legal?

I had to speak to a solicitor before I signed anything. They should do this. Otherwise they are simply resigning. I think, anyway. They need to check it out.
