Maternity leave pay back

Hi all,

I have a job offer; it’s a contract role therefore they will not wait as long as a regular employment will wait. However I have been back from Maternity leave for 5 months. And I have 3 month notice period.

my policy states;
‘Should you leave the business within 6 months
of returning to work you will be required to pay back the bonus’

if I hand my notice in now, that is at 5 months but wouldn’t leave until 8 months (if I have to work 3 month notice period). Will this be enough to leave without paying back the bonus despite showing my intent to leave before the 6 months?

Yes I would say so. You aren’t leaving the business in 6 months or under

Could you hand notice 1 day after 6months and take the last few weeks as holiday?

i won’t have enough leave unfortunately as notice period is 3 months and I would have to wait 1 month to get past the 6 month mark. So will end up being over 3 months to get to new job even with taking a couple of week leave
