Maternity leave and holidays

Im Currently on maternity leave
prior to going on leave I worked 30hrs a week Tuesday- Friday.

my employer has advised that they will shut on Friday 27th and it will be an extra day off for everyone. As I’m on maternity I’ve been told I’ll receive 6hrs pay for this instead.

can they do this?

if I wasn’t on maternity I’d be paid for a full day (7.5 hrs)?!

Sounds like they have made a mistake - it happens - remind them that you are e.g. contracted 4 x 7.5hrs days, not 5 x 6hrs days, with Friday being one of your working days, therefore they have to pay your for the hours you would otherwise have worked that day.

Yep should be 7.5 hours as above. Most work places don't hold a central database of people's working patterns so a calculation has been made on the assumption you work 5 days a week.

I think they have pro rated because it is an extra days holiday I.e. you get 30/37.5 x 7.5 hours =6 hours.

The question is how do they normally pro rata your leave?

Are you on the unpaid portion of mat leave or paid?

I would actually think it’s correct if they usually pro rata your leave. You work 4 days a week so get 80% of the hours as pay for this extra leave day.

Isn't it just a goodwill day offered ad hoc on top of contracted leave to those who would normally work that day?

It'll be pro-rata'd. Don't think of it as a day. Think of it as the company are giving each employee 1/5th of their working week off. For 7.5h a day, 5 day a week employees that's 1 day of 7.5hours. For you, that's 6 hours.

Technically this way is fairer, or you'd be getting 'more' than your colleagues (1/4 of a week!) it's the same logic used to apply Bank Holidays for PT colleagues too.

If it is an extra day off then they are correct it is 6 hours. You are receiving 80% of a full timer as you work 80% of a full time week.

Another 80% part timer who didn't work Friday should have 6 hours added to their leave.
