TUPE and changes to T&C

My current employer offers very good enhanced occupational maternity pay. The business is undergoing some changes and we may be transferred to another employer in the next few months. We've been told if that does happen, transfers will be done under TUPE. My (limited) understanding is that businesses can change T&C to poorer terms if they can show a valid ETO reason. Does anyone know how likely it is that we'll be able to keep the enhanced maternity pay part of the contract?

It just depends on how much they want to take it really. They could argue it’s a cost cutting economic reason under ETO.

Doesn't the cost cutting economic reason basically mean they can change any of the T&C's then? Bit worrying as we're TTC and don't want them to pull the maternity pay if we do conceive 😕

Basically, yes. The ETO rules mean if they can make a clear case for it, under economics, then they can yeah.
