Grievance/Settlement?

I have been employed 7years with company. My team was a team of 2.5, 2 f/t, 1 p/t. P/t moved to another project, was never replaced, f/t has been on long term sick for 26 months. This leaves me and I just can’t cope anymore.

I’ve asked multiple managers, multiple times for replacements to no avail. Of course they have watched me do the job so probably don’t see any point spending to replace. But my health has suffered considerably, signed off for 8 weeks last year and now I’m off again.

I catch everything that is going, my immune system is at the lowest and I think it’s due to my stress levels although I can’t prove that.

I could put in a grievance but I am well aware it will make no difference before I stress myself further.

What do i do, can I ask for a settlement to leave or is grievance the only way to go?

You need to ask yourself why should they settle. What are the consequences of them not settling? Usually companies settle to avoid expensive legal/tribunal cases and it is more cost effective to settle.

Do you have a case against them that you could pursue?

Why would they settle? What would your grievance be?

They will argue wether it is true or not that you are not doing the work of 2.5 people as that would be impossible without you working the hours of 2.5 people.

If I was you I would just look for another job.

You are going about getting replacements wrong.

As long as you continue to stress yourself and work extra hours to absorb the work there is absolutely no reason why the company will backfill the roles.

What you need to do is write down all the activities you do, the volumes and the amount of time it takes to do them (realistic timings).

You then work out on a weekly basis how many hours worth of work there is to do. If you work 37 hrs then you assume you are available 30 hours because the other 7 will be coffee/toilet breaks potentially a day off, adhoc requests and so on.

Then what's left is work you can't do.

You then go to your boss and you say I need to either get replacement staff to do this x worth if hours work or you need to remove those tasks from this teams workload and reallocate it or deprioritise it.

With regard a settlement i can't see why they'd offer that, you've said your role is needed so they would have to replace you which means they are unlikely to pay you to leave.

You can obviously quit and maybe that would be a good option for your it depends on how much you like the job and company and if there are any specifics like location/hours that will make moving difficult.

Thank you, I see you what mean. I have been doing the work but struggling a lot but of course my employer isn’t concerned as the work is being completed.

I think you are right, time to look.

Thank you, that makes sense. I think I have probably passed the point of thinking what to do next logically. At one point I even halved my hours and went p/t, I was at my wits end and not coping. My employer didn’t even change my workload or employ anyone else, 3 months later I ended up back f/t as I was no further on.

Ive tried so many things, have stings of emails to different managers to be told over and over they can not replace my colleague as he is still officially employed even though they don’t pay him.

What size of organisation is this? What are they doing about the person on LTS, have they made an occupational health referral and started the process of managing them out?

Not a big organisation at all, think under 30 people.

As far as I’m aware they haven’t done anything as yet to start the process of managing him out, I know they are hoping he will just resign but im aware this isn’t going to happen as he has told me!
