Dismissal appeal

I was dismissed recently due to ill-health related absences, including one absence which required a hospital admission. I have formally appealed and had the appeal hearing.

My former employer told me they would inform me of the outcome within 5 working days. However, it has been 7 working days now and I haven’t heard anything yet.

What could the delay be?

Sorry to hear this has happened to you. I’ve recently heard a lot about people being dismissed or pushed out due to health reasons and it’s genuinely shocked me, although maybe I’ve been naive about this sort of thing.

Do you have a solicitor? Is the appeal being dealt with solely by the employer?

It could be anything - I appealed a flexible working decision once, quoting my solicitor and ACAS and the delay came from them crapping themselves that they’d messed up and trying to come up with wording that didn’t spur me on to take them to tribunal.

I hope you get the resolution you want.

… also I would rigidly keep them to their schedule or at least email them to highlight the delay as evidence for any future action.

Could you contact the appeal panel leader and ask for your letter and a reason for the delay rather than waiting?

Thank you. I still haven’t heard anything, so I’m tempted to write to them.

I just don’t want to ruffle any feathers, in case they do decide to reinstate me…

The appeal is being dealt with via an external HR company and someone on the board of governors.

ACAS has given my a certificate to take them to tribunal, if want to. I have been sent a witness statement from ex boss saying they put in a number of reasonable adjustments for me, but what they had listed were just general working practices available to everyone anyway… think being able to contact line manager and use of first aid room etc.
