Contract hours wrong , who's at fault ?

I went back to work and my hours were stated as 8am to 4pm with half hour lunch . No problem but then when I got to the office of employment the manager asked if I could do 8 - 4.30 still half hour lunch . I agreed .

Fast forward to pay review this year and I've seen my online HR records me as still 37.5hrs per week so essentially I've been doing an extra 2 1/2 hrs per week for the last 3 yrs .

Is this my fault for not checking of the managers for not letting HR know my change in hours . Also will I likely get back pay or time in lieu or has it been going on to long .

Any help appreciated

So your contract says 37.5hrs and you’ve been paid for that for three years? Are you on an hourly rate or salary?

Do you know if the extra 2.5hrs you’ve been doing per week unpaid would put you under the minimum wage?

Wouldn’t your pay have reflected the actual hours you’ve been doing? Had you not noticed you were ten hours short per month?

The salary agreed was for 37.5 hrs , as for noticing it's hard because it differs each month dependant on bonus figures .

I'm paid a salary and it was the minimum wage increasing this April that made me look. When I worked it out it didn't look right so queried it with boss . He came back and said no it's right for 37.5 hrs and I said but I've been working 40 hrs so he said ' oh shit you have ' . He has now referred it to HR .

@hattie43 your starting point is whether or not you have been paid at least NMW for a 40 hour week. Remember there are 52.18 weeks in an average year.

It does look like you have been underpaid- glad you spotted it and your boss had referred it. Hopefully you will get increase plus some back pay!!!

I would ask how they propose to resolve the issue, moving forward and also in respect of the last three years. Not sure on the legals on this one.
