Holiday Entitlement? Is this right?

Hi,

I started new Job on 2nd May and have 25 days annual leave with bank hols on top.
I work Mon to Fri 37.5 hrs week.
Holiday year is Jan to Dec'24.
They have calculated my remaining holiday to be 12.75 days. I can't work out how this has been worked out as I expected few days more than this.
My HR is on holiday so will get them to confirm when back but wanted to see if anyone knew how this may have calculated

Surely it should be 2/3 of the 25 days AL, to cover May-Dec, plus the 5 bank holidays that occur after Easter?

Do you have to take compulsory days off during the Xmas week? If so maybe those are deducted

I work your holidays out to 16.5 for annual leave and what ever bank holidays are left to take.

If you have to complete a full month to qualify then May doesn't count and it will be 14.5 again plus what ever bank holidays are left to take.

Please check with your HR department to confirm how they made the calculation.

25 days /366 x 244 = 16.71 days plus ABH, XD and BD bank holidays.

Do they have a mandatory shut down period over Christmas and New Year?

I thought the rules were that you got a full month's stat holiday for your first month regardless of the start date. And they need to round up to the nearest half-day - so it can't be 12.75, it would have to be 13days. But these are the rules for stat holidays ie the 20 days plus bank holidays, your company rules for the extra 5 days are whatever is written in the handbook or in your contract.

The total holiday entitlement for staff working the full year is 33 days (25 days + 8 bank holidays). You should receive two-thirds of that (in theory slightly less than that because you started on 2nd May, but that is still going to round up to 33 days). So, we start with 22 days. There will be 5 bank holidays, so that brings it down to 17 days. If they have any fixed closures (e.g. over the Christmas period), they also need to come off. So, if they have 4.25 days when they close, that would make their figure correct. However, that seems unlikely. I would ask how they have calculated their figure. I would also point out that, according to the government's holiday entitlement calculator at Calculate holiday entitlement - GOV.UK (www.gov.uk), you are entitled to 19 days statutory holiday. Taking bank holidays off leaves 14 days, so unless there is a fixed closure which is additional to the figure they've given you, they are giving you less than your statutory entitlement.
