Overpaid - net or gross repayment

I was overpaid in a previous job. Once it was pointed out I agreed a repayment plan for repayment to be taken from pay. I met most of these before leaving the company. I am.now being asked to pay the remainder of the gross outstanding. I haven't had the gross amount and there isn't a payroll system in place to offset the tax, so should I be paying? It doesn't seem.right that I have received net but paying back gross.

If your employer was dealing with your tax through PAYE then I'd have thought you'd only have to repay the net and then they'd claim back the tax they deducted for the overpayment. ACAS will be able to give you chapter and verse.

Thank you..sadly Acas can't help as they can only give general advice.

You only repay what money you actually received. Not the gross.

Was it PAYE?

It was through my payslips which I think means PAYE. Now i don't work there any more so no PAYE

They should have sorted the pension, tax and NI via payroll, you should only re-pay the net you were overpaid.

Ask them for a precise breakdown of all elements up to your leaving date.
