Help!! Bank Holiday / Contract Query

I have a question regarding annual leave entitlement. The statutory minimum is 5.6 weeks (aware that this can include bank holidays). If you're not contracted to work Mondays but still work 5 days a week, how does this affect your annual leave entitlement, especially considering that 5 out of 8 Bank Holidays fall on Mondays this year? I've received conflicting advice and would appreciate any clarification.

Statutory leave is 28 days. If your 28 days include bank holiday's then it doesn't matter which 5 days of the week you work. You still get 28 days, but you get to choose all of them (unless the employer dictates some leave).

I work 3 days a week (part time hours). My leave is all calculated in hours.
When my days were tues, wed, thurs I was entitled to pro rata hours for public holidays

You will get 5.6 weeks holiday but will have more choice as to when to take your holidays as you won't have to use any of your leave for the bank holiday Mondays

E.g. if you worked on a Monday you would need to use 4 days of your leave to cover bank holiday Mondays this year

If you don't work a Monday you have more choice as to when to take those 4 days of leave.

You get the same leave as everybody else, so if it is 28 days then that is what you get. If there are 3 BHs on your usual working days then your employer is allowed to mandate that you use 3 days of your 28 to cover those days. The remaining 25 days you get to choose when to take.

Thanks all. That's what i'd assumed. The contract states 30 days which include bank holidays. Looking at the holiday system and there are only 22 available to book.

They cannot deduct the Monday bank holidays if you arent due to work them. I would raise it with them

The holiday system probably has a default setting which deducts the bank holidays automatically - someone should be able to override this for people who don't work Mondays & only leave the non-Monday bank holidays (Good Friday etc) as deducted before remaining allowance is displayed.
