I’m just wondering for anyone who has put one in against their employer for a serious breach, how was the process on you emotionally? I know this is going to vary between individuals but whilst I know I’ve been deeply wronged I’m not sure I have anything left in the tank to deal with it. I also don’t really have any emotional support in the way of friends/family and I’m trying to juggle various other things. I don’t have a solicitor or access to one either so I’m basically going it alone through ACAS.

Is there any shame in just walking away and not?

@Doggymummar what percentage of your schedule of loss did the £10K reflect? I assume the £10K was an out of court settlement before the hearing started?

£10k is quite a high award for a tribunal to give. It may have been a settlement, but don't assume so. The average award for unfair dismissal, for example, is only about £13k. But averages are not helpful because the very small number of high awards make the awards look better than they are. Using adapted figures for median awards is more reasonable, and for unfair dismissal that is only £6200! People think that awards are huge due to headlines - there's a reason for the headline figures, and it's because almost nobody gets them!

Constructive dismissal is a type of unfair dismissal claim. Essentially, it is where an employee is forced to resign or leave their job because of their employer's conduct. An unfair dismissal is where an employer has ended the employment relationship and dismissed their employee unfairly.

I have no legal knowledge at all OP. But my friend (Employment Lawyer) says constructive dismissal is very hard to get, and you're better off going for unfair dismissal. (No legal knowledge at all, but just a basic recommendation).
