Outside IR35

Does anyone work on a contract that is outside IR35? Would you recommend it and is there anything I need to be aware/cautious of? Am currently on a fixed term contract that is via PAYE. I've been offered roles inside IR35 but this is first time I've been offered one that is outside. The info online is so confusing so would appreciate some advice, thank you.

Is it really outside IR35? Why?

No idea why it's outside IR35, it makes me feel uncomfortable but not sure why, also seems a lot of work to set up a Ltd company.

IR35 relates to engagements through an intermediary, basically you'd have to set up as a Company for IR35 to even be a consideration in the first place.

If you do take the engagement and its not within the off payroll working legislation on the engagers side, then your company needs to assess whether the engagement falls within the IR35 rules, and apply them accordingly if it does. Therefore you need to understand the rules and how they apply to the engagement.

Ask to see the SDS. It's basically a statement which explains why the client has reached the conclusion that the role is outside IR35.

That aside, it's really not difficult. Set up a limited company, takes minutes. Register for VAT if your turnover will take you over the threshold. Register as an employer if you plan to pay yourself as an employee (in full or in part) through PAYE.
