DD has not been paid

Hi,
So my dd had a quite stressful job and had a massive amount of pressure and responsibility at 18. She had been in the same job since 13 working weekends. About a month ago she had had enough of the 50plus hour weeks and being spoken to like crap, after another incident she walked out. I completely backed her decision as she was so unhappy and exhausted. The problem is she has not been paid for her last weeks work. My dd has emailed twice and asked for her pay and p45 but has had no reply at all. Unfortunately my dd won't go and see her as she hates confrontation and has just said to forget about it. It's nearly £1000 so really it needs sorting. Just not sure where to go from here. I don't really want to get involved as she is an adult but don't know what to do. Any help/advice would be hugely appreciated. Thank you x

It’s unlawful deduction of wages. They probably also owe holiday pay.

I agree having written twice raise this with ACAS for mediation.

If she wanted to get them into trouble she could also report them to HMRC for not paying minimum wage in her last month. https://www.gov.uk/government/publications/pay-and-work-rights-complaints

Complain about pay and work rights

Use the online form to complain about not being paid the National Minimum Wage, employment agencies, gangmasters or working hours.

Might they think she is in breach of contract eg didn't work a notice period?

Snoeberry · 08/11/2023 22:17

Citizens advice? There will probably be template letters on their Website to write to ask for what she's owed.

They still have to pay for the hours she has worked.

Do you have legal cover on your house insurance? (Or through a bank account or union membership etc etc?).

if you do, talk to them to get advice and see if they will chase the employers for you. Would show ghat she is serious!

Annony331 · 09/11/2023 01:49

Speak to HMRC that a P45 is being withheld. They will contact employer to lay out legal requirement to produce one.

She has finally been paid but still hasn't received her P45

HMRC can issue a duplicate or just say to new employer she doesn't have one it's not a big deal. Will probably COME Iin a few days

Sisterpita · 13/11/2023 19:47

Glad she has been paid. I would expect a P45 to follow in a few days.
