Did not accrue bank holiday while on mat leave

I work in the UK and had mat leave in 2021 to 2022, I’ve returned to work now but I’ve now discovered the law that I was entitled to accrue my bank holidays as well as my holiday entitlement.

I was never made aware of this and I did not accrue the bank holiday days whilst I was off.

what rights do I have? Can I ask to be paid for them as it was now a couple of years ago?

Some employers don’t count bank holidays as annual leave and pay it as and when they happen. My sister and I where on maternity leave at the same time. Her employers paid her bank holidays as they happened on top of smp, mine accured hours of additional annual leave. Why not check with payroll or hr what the process is!?

The way to think of this is if the business overpaid you they would ask for the money back. Talk to HR and point out that you have just noticed they did not give you your full leave entitlement and ask if you can either add the difference to this years allowance or be paid for the time.
