Think the Manager is wrong

Hi,

I finally got my Manager to call me, asking if I should contact Head Office. I’m on sick and there has never been any discussion until now what happens to annual leave. Seems never given it a thought?

I’m looking to return next week as our holiday year ends.

I don’t know whether the manager is having another one of their jokes or genuinely doesn’t know the in’s and outs of employment.

He actually tried to tell me my holiday was soon to be lost oh well hoping that was enough to quieten me. They say I have 14.5 days behind me, what they said next has thrown me - I could either carry the whole lot over (which I’m against due to the difficulties in the past of taking annual leave.) it seems that if I insist on being on holiday next week I lose 10.5 days?

This flies in the face of what ACAS website seems to state.

Do I leave it until the 3rd April to find out if he is really so misinformed or go to head office before we really do reach 1st April to understand if he is just making all of this up.

I have asked in writing following the call if they intend a phased return will use up the ‘new years’ leave to supplement full-time hours.

I’m really confused as the occupational health report went to a named person in ER (Employee relations) at Head Office so I guess I have someone to ask for if it came to it.

@MumOf2workOptionsYou can't be off sick and on holiday at the same time”

Yes you can, HMRC vs Stringer case law established this principle.https://publications.parliament.uk/pa/ld200809/ldjudgmt/jd090610/string-1.htm

Apologies I was deeply baffled too, I was being held over a barrel by the Manager who said I could only carry over full leave from this holiday year (their calculation of 14.5) they certainly aren’t apparently carrying over 10.5 days after 4 days holiday. (I really hope the Manager is having a jolly) but, if I have to write it off I will, it’s a notorious enough industry as it is.

To my mind I could have resigned last Friday giving notice and been expecting full holiday pay to be paid out so I was a bit bemused what the manager claimed was going to happen.

I’ll know at a glance next Monday what they’ve done as fortunately the leave booking is done on a system and from what I remember let’s you see leave totals.

Yes it’s correct I’d rather have annual leave then take any further fit note especially given I now have an interview arranged so far rather that be on ‘my time’ then theirs.
Plus I’m back from an outpatients appointment where they have said they can do anything more for me and I’ve just got to live with after effects of surgery so feel that’s reassurance to try going for a new job.

I’ve tried getting in touch with head office but I didn’t realise all the phone numbers I hoped would get me through have been switched off so after the absence line just told me only avenue is through the Manager and won’t be putting me through to H/O I’ve sent an email asking them if I can speak with a member of HR / ER. I just didn’t want to get to 3rd April and Head Office then say why haven’t you raised this sooner. I’ve reached the point where I would be best if they said goodbye as every interaction with the Manager hasn’t been the best and honestly for the life of me I can’t understand why they haven’t let me go in the time I’ve been recovering. But as Dad said if they want me out, they’ll just refuse holiday in future anyway.

Sorry for the grief caused. Aaargh if holiday year had been Dec to Jan I bet none of this would be a problem. Sincerely hope the Manager is just having some sort of joke on me.

The employer confirmed it was all a ‘big joke’ a few hours ago before 6pm.

The Manager has in ‘special effort’ claim they have requested 10.5 days be carried forward. Personally I wonder if I foiled their goodbye plan.

Punctuation would help
