he does qualify and should go to citizens advice

dementedpixie · 30/01/2023 13:42

He neded to be employed for at least 6 months by the time the pregnancy was at 25 weeks so it's likely he didn't qualify

dementedpixie · 30/01/2023 13:44

Could he take annual leave instead?

Comefromaway · 30/01/2023 13:47

What was the baby's due date (not the actual date of birth, the due date)?

Based on the information you have given it is unlikely that he qualifies as he has not worked there for long enough.

This is in the eligibility criteria:

  • have been continuously employed by you for at least 26 weeks up to any day in the ‘qualifying week’

The qualifying week is the 15th week before the baby is due

So at the 25th of pregnancy he would need to already have been employed for 26 weeks. Doesnt look like he qualifies

If you were already pregnant at the time he joined the company, most likely he doesn't qualify. You need to look at the exact due date in your maternity documentation
