INJURY AT WORK QUESTION

Hi

So my husband had an accident at work (he's a bus driver) back in August due to a car crashing in to his bus and he suffered whiplash (confirmed by a his work told him to put a claim in with the company's approved solicitor but looking at all the documents and what the solicitor is claiming from the person who caused the accident all they are claiming for is loss of earnings (which was minimal due to work sick pay) and prescription fees. If the claim is approved the sick pay bit obviously goes back to the company as it is refundable sick pay. So there is nothing for the actual injury claim.

My question is could he claim for whiplash (I know this is only a small amount of money now) with one of those injury no win no fee companies or would it be rejected because of this loss of earnings claim his company sort of pushed him towards claiming?

Surely it would be more logical in the first instance to query with the company solicitor why personal injury hasn’t been included in the claim?

The solicitor should be checking with him what he needs to claim for. As PP says, he needs to ask the solicitor why he wasn't asked
