Sick leave and now employer can’t pay me my wages 😢

So today I found out I have a nerve problem with my neck shoulder area. Dr has written me off another week. Now my employer has just told me the business does not have funds to pay my Nov and Dec! I’m so worried because of my rent at my temporary accommodation/council tax and other debts. Do I need to get a formal letter from my employer to show the council? My employer also mention she may need to give me 1 months notice if the business does not pick up by mid December - Any advice please x

Your employer isn't likely to give you a letter admitting to breaking the law. If your employer can't pay you then they are trading whilst insolvent. You need to seek urgent advice from an advice centre / CAB. It sounds like you have a complex situation even before this, and that needs proper advice, not guesses from well meaning strangers.

How long have you worked there for? Are they still trading? Are you being made redundant? Are you a member of a union?

Do you just get SSP or Occupational sick pay?

If it’s SSP then your employer must give you an SSP1 explaining why they are not paying SSP. Take the SSP1 to your job centre as you may be entitled to benefits.

Thank you all. Yes it’s a very complex situation I’m in with all this pain I’m going through and on top of this my employer can’t pay my wages. That’s exactly what I thought, but she mentioned she had to pay up £3k to hmrc to keep the business up and running? I’m very very confused - I have asked her to send me the letter before 9am tomorrow so we shall see.

I started in Jan 2022, I believe the company is still trading and I’m not part of a union. She did ask for my updated sick note today and I’ve sent it to her so she can update on her end. It does say on my contract she can give me one months notice, so practically she has given me the heads up. By next week she will know more about what’s going on and if she can’t pay me for future reference she will give me my notice 😩 I will call CAB tomorrow
