Paternity leave and notice period

Hullo all, would really appreciate some views on this.

My husband has found a new job and has to give two months notice to his current employer. He's currently entitled to one month paternity leave.

If he hands in his notice one month before the due date, does that mean he will have to work one month and can then still go on paternity leave before leaving?

We've looked at his contract and there's nothing there that covers the situation so I assume his current employer can't cancel his paternity leave?

Yeah if his official employment end date is the end of his paternity leave. I'd check what pay he's entitled to though because most places will expect you to pay back anything more than statutory leave - like if you're paid more than SMP then don't go back
