Hey,

So my baby was born premature last September and i’m due back to work at end of September. I’m currently on maternity pay as i didnt qualify for SMP or maternity leave as didnt work in job long enough. I’m looking to quit my job as i want a bit more time off with my baby because she was premature im worried about missing milestones. My question is this - could i take the rest of my holidays at end of September and then hand in my notice? I wouldnt owe them any maternity leave money as they dont pay me it. Just a bit confused what to do really? Would i still be entitled to my holiday pay if i hand in my notice? TIA x

You are entitled to be paid for annual leave accrued during may leave. You don't need to take it.

You should give them notice 8 weeks before the end of your full 12 months mat leave that you will not be returning to work with a finish date. On that date or before you should be paid your full annual leave entitlement and the get your P45.
