Am I being a CF? Furlough, holiday and redundancy

Hi

Not sure if I’m the one being a CF and would appreciate others opinions please.

I was due to take a weeks holiday in April then 2 weeks in May but was furloughed at the beginning of the scheme. Have since been made redundant and my last day will be July 31st. Employer is refusing to pay accrued holiday for the year as they say I have had my holiday entitlement (no holidays for the year apart from the booked ones above). My argument is that they have claimed the furlough payment for those 3 weeks and only paid me 80% therefore I still have the holidays. Am I right? If they had topped up to 100% for those 3 weeks I wouldn’t be even be querying it. I just don’t want to take it further if I’m being a CF!

They needed to pay for the holiday time, not the furlough scheme. If they didnt then they owe you the holiday time.call CAB for advice on how to get them to pay, or report them for fraud with the furlough scheme.

You need to calculate your pro rate days. Eg holiday year runs Jan to dec and you get 30 days. 30/12*6 = 15 days which covers your 3 weeks. They will be due you the extra 20% for these weeks.

Holiday needs to have been paid at 100%. If the annual leave you had booked wasn’t cancelled, ie you effectively took it at the times booked, then they needed to top it up to 100% and will owe you the difference.
