Maternity to furlough to redundancy

robynclen · 22/06/2020 18:29

I have just found out that I’m being made redundant on 31st of July.
I was on Mat leave when lock down started then went onto furlough.

Do I have any standing to try and keep my job or bring a case against them.

Because I was put on furlough does that cut my maternity rights?

The company is still operating but making many redundancy’s.

Any advice would be greatfully received.

Hi op
Do you feel the redundancy is unfair in such that your rile is still active
And you have been discriminated against due to mat leave?
If yes in what way
You can be made redundant in the circumstances you have cited so its wither its been fair
And if the correct consultations and processes have been followed

How long have you worked there
Have you been offered any alternative employment within the company
Is there a like for like available/viable option or are all available simmilar roles being made redundant?

I work as a recruitment consultant in a large company with many other people of my level
I think I have been discriminated against due to mat leave
I will be 13 days under 2 years working there when redundancy starts.

A few more questions sorry!
Have you asked what the criteria was for being at risk of redundancy?
Has anyone not been made redundant who had less experience than you for example only worked there a few months before furlough period started etc?

If you were on mat leave- one thing i know is different is that you need to be given priority of alternative vacancies over others who are not on mat leave but it doesnt seem there was any alternative employmebt opportunities anyway? And you were not longer on mat leave so were in the same "pot" as everyone else

Did you finish mat leave early to make use of furlough or was it your natural end?

robynclen · 22/06/2020 19:02

Mat leave finished naturally
Not sure about the other redundancies
I was told that each case was evaluated on a case by case and one reason I was given was that I haven't been in the company for the last year. (Maternity and furlough) however this was not in writing.)

My decision closed while I was on mat leave and I was due to start in a new area in an equal job.

Devision not decision

To say the reason is "you hadnt been in the company for the last year" is an absokute kick in the teeth and could be deemed discriminatory was there any witnesses to that?

It would be extremely hard to confirm that the mat leave was the reason and it is discriminatory in the circumstances youve given but acas are great to talk through and maybe even pregnant and screwed website may also have some more advice

I hope you get something sorted soon
