Am I getting the right amount of holidays? Help!

Hi,

I've just come back to work after maternity leave

I now work 2.5 days a week (Wednesday afternoon 3 hours, full days Thursday & Fridays)

My question is how many days holiday should I get? I've been assigned 14 & told that when I book a Wednesday off I need to use a full days holiday not half a holiday. This means in reality I only get 4.2 weeks off holidays a year? Surely this isn't right or is it?

(Full time staff get 21 days (if worked there under 2 years) & 25 days holiday (if worked there over 2 years) plus every bank holiday off)

If not I think they are right. 21 days plus BH is 29 days. Your 3 hours isn't a whole half day. So just under half holidays would be right.

I'd ask to see an hours calculation to see how they work it out.

Does anyone there ever use a half days AL?

If so you will be in a much stronger position to argue only using half a day for weds.

I presume if you take 3 days AL in one week they would have to pay you for 3 full days, instead of your usual 2.5 days?

@Dermymc hi, yes I've been there over 2 years & I meant to put 3.5 hours which is half of the day. We work 8 hour shifts but do not get paid 1 hour lunch so technically it's 7 hours paid (meaning half day is 3.5 hours)

I work 2.5 days and get half the fte annual leave.

I only take half a day of leave on my half day working day.

What is your ratio to full time hours wise? Do you work longer hours on the other days?

From what you have described it doesn't sound right.

If you're there exactly half the time, you should get exactly half the holidays.

I'd propose to them that you get half of 33 days (16.5) but you have to book bank holidays off. Then you'll get the same entitlement as a full timer. Wednesday should definitely be only half a day.

I don't know what they have done to complicate your leave but I don't understand why you have more than .5 allocation of leave.
Why are you expected to use leave for half days when you are not paid or required to be in work? Makes no sense.

You should get 16.5 days holiday then, and if a bank holiday falls on a work day it comes out of that entitlement. If you work a half day you should be able to take half day holiday. As Goody asked, can you take a half days leave at present anyway?

Is this because they are quoting holidays and working days in full days rather than hours?

You need to convert your days leave into hours - so ft get 25 x 7 = 175 Pt get 25 x 3.5
= 87.5

You take 7 hours leave on a full working day and 3.5 on a Wednesday.

You’ll need to figure out your bank holidays too cos you’ll only get half of those but as most fall on a Monday, your employers will effectively ‘owe’ you half a day every bank holiday Monday!! This is why working the end of the week is always better when going part time!!

Full time hours -

Monday - Friday 9-5 (1 hour lunch unpaid so works out at being 35 hours per week)

My part time -

Wednesday half day (3.5 hours)
Thursday 9-5
Friday 9-5

I work exactly half the week (17.5 hours per week)

Yes it does moretea - the entitlement changes with how long you've worked there and they can't discriminate against part time workers. Maybe you should check your own facts first...

I think they have worked it out based on me doing 2.5 days which is correct but now as there making me take 1 whole day for a Wednesday it is making me worse off

PT workers cannot be discriminated against for being PT. They are entitled to the same amount of holiday pro rata. Check your facts.

None of it sounds right to me OP! Bank holidays need to be taken into account. Can half days be booked off normally?

Yes half days can be booked off! I've been told if I want to use a half day it has to be on a Thursday or Friday an NOT a Wednesday 🤔

I'm defiantly going to question this again tomorrow. I have already questioned it but got brushed off as I didn't know any facts then...

But you’re not booking half a day. You are booking a ‘full’ one of your working days!

They haven't got a leg to stand on. Try not to be confrontational, just show the working out for the days (including bank holidays) and say that it makes no sense that Wednesday needs to be a half day. Hopefully it is incompetence rather than being malicious... If they still are arguing against then go to ACAS for help.

They could be working half days five days a week. Should each of their 'working days' be classed as a full day in holiday terms? Makes no sense.

@Crikeyblimey I don't think you understand. They have worked it out based on me working 2.5 days, not 3. If I have to use a full holiday on a Wednesday they should of worked out my leave as 3 working days then.
