My DD handed in the last of her coursework on 6 March which was the date the apprenticeship was due to end. The apprenticeship tutor confirmed that everything was in order. The Manager of DD company was not in the building that day so did not see the apprenticeship tutor.
The company my DD is at agreed to keep her on so she was expecting a pay rise from 6 March. The company, in all fairness, had been paying DD NMW for her age (20) for the last few months in recognition of her work and indicated that they would increase it to NMW for 21 year olds on completion of her apprenticeship. There are other 20 year olds with the same qualifications at the company that are on the NMW for 21 year olds.
The company however have now said they would only pay her 21 yr old MNW from the date they received confirmation from the apprenticeship company. This was not received until 6 weeks later despite my DD chasing them - they claimed to have a backlog of admin.
As they were paying her 20 year old NMW for those 6 weeks rather than apprenticeship NMW I guess they can claim that they have fulfilled their obligations but I just wanted to check whether they could change their mind (she was only told it by the manager and has nothing in writing) and because they are paying other 20 year olds the full NMW can she insist on being paid the same?
I'm not holding out much hope but £480 is a lot to a 20 year old.
