Left job, I haven't been paid

Got a job up the road to pay the cat's vets bills. In a restaurant. After a third degree burn from chef, accident, had to leave.

They owe me for the training, for the untaken holiday, for the last two days I worked there. I've emailed about it twice and been told it would get paid immediately. Nada.

What do I do?

When did you leave? When do you normally get paid i.e. monthly or weekly and on what date?

Left 3 weeks ago. They owe me one because I could have made a fuss re damages & the accident very easily. Should have been paid in full 2 weeks ago, pay is weekly.

Do not confuse the two issues of pay and the accident. If your outstanding pay is overdue, write a letter to them, sending it recorded delivery, outlining the money you believe is due to you for work/accrued holiday and training (not sure about the training, is this training which you paid for yourself to be reimbursed or training which you undertook at work additional to your normal hours?). Give them seven days to make the transfer to your account, presumably you also need a P45 from them?

I'm not sure why you felt you had to leave your job however? If you were injured at work, surely you should have been on sick leave and would be better receiving some money from that rather than none at all now? If you genuinely believe that you suffered an injury through the fault of your work, then of course you are perfectly entitled to sue for compensation but you would be expected to have taken steps to mitigate your losses and resigning is not necessarily the first step to take.

Call ACAS on 0300 123 1100 and take your lead from their advice.

Most shysters employers will pay up if they know you have been in touch with ACAS first.

And I agree that the accident and the missing pay are two totally separate issue's.

Fwiw an accident causing you to leave will be a lost cause in terms of compensation for it etc. Unless you are so severley injured that you are unable to work at all now/in the futureit's just not worth persuing imho.

I was in a rush with my previous message and meant to add that if you left without giving proper notice the employer may be withholding pay because of that. What was your notice period and did you stick to that?

I left giving more notice than was required - a week was the contracted period.

Even if you leave with no notice whatsoever- they still have to pay you! Again, the two points are unrelated.

Yep, I know they are. Update: After two emails and two phone calls from me, there's still no date for getting paid and the money is seriously late now. No P45 either.

Acas say start escalation process ie tribunal, but the pub are idiots, they won't win.

Would small claims court work better for you?
You'd have to show you've formally requested the amount owed. It costs about £30 and if you win and they don't pay, you can employ an enforcement agent to get the money and costs for you.
