TUPE on mat leave - new conditions a lot better

I'm about to move onto a new contract due to company merger. Started mat leave a month ago and now been given the new contract, when I finished work they didn't know when contracts would be transferred.

The new mat leave policy is a lot better (currently just smp). Does anyone know if I'm entitled to the new policy even though I've already started mat leave?

Think the conditions applying at the time you went on leave continue to apply, sorry if that means you lose out. Anything paid above Smp usually has conditions attached.

Thanks. Wanted to be sure as hr haven't always got things right. Shame as new policy is 6 months full pay and a return to work bonus of a months salary once you've been back 6 months. There are payback conditions but only if you don't return (I need to) or leave (don't expect to).
Looks lokr I will have only missed out by a month!

but it works mostly in your favor if the condistions get worse during your mat leave they cant stick you on that so all in all its a good trade off
