I wonder if anyone can give some advice on this situation? My DP's resigned from his job a few weeks ago. A shorter notice period was agreed along with payment of commission of one deal that was signed off but with no start date (he is in recruitment so start date is referring to a candidates start date). This was verbally agreed and DP them summarised this in a email to his boss, boss responded with a 'keep in touch'.
DP has been in contact with the candidate and client and start date was agreed. DP then rang old boss to check all was well, boss said he hadn't rung the client himself but that deal would be paid on. Then we get an emailing saying that as the deal was not on the system by today (I suspect this is a paper work issue) that he will not be paid.
A start date was needed to put this deal on the 'system' and boss was well aware this start date may not be confirmed until after now when he agreed to pay the commission.
Is there any point trying to pursue this? Is a positive response to DP's emailing outlining what was agreed (insomuch as if he was going to add strings to the commission he should have said so in the email) good enough to get some legal advice? We are not talking a fortune but it's enough to get us away for a week.
