Employment Tribunals- Schedule of Loss/Summations

Hi, I'm new here, so I hope this is the accepted way to do this.... :-)

Can anyone help with some advice on how to do these? Basically, I have had a four-year fight with my employer, and I'm due back at the Employment Tribunal soon as the case was so long it was adjourned. My Union backed out on me almost from the beginning, so I'm representaing myself against a large employer. There is no legal aid available for this kind of case, and I'm struggling to live, let alone pay someone....

I've been told to go and do the Schedule of Loss again,and to prepare a summation. Has anyone been through this? Does anyone have any advice to offer? I've looked everywhere on the internet, and can't find any sort of proper guidance.... so Help!!!

Hi. You say "employer" rather than "former employer" - are you still there? Without going into details, what is the nature of your claim?

Look at the Consumer Action Group forum, if you haven't already as they should have some similar threads with some of the info you require.

Go to your local university library and look at their employment law section. (if they do law courses) . You can usually sign in as a visitor. They will have handbooks on employment tribunal procedures and examples of schedules of losses for different claims. Also your local CAB should be able to give you some advice.

It's my ex-employer, I was sacked by them a year and a bit ago. I have tried the CAB with no success (thery looked at me blankly to be honest), and then they told me to go to my union (who had already stopped supporting me). Claim is largely about Unfair Dismissal and Discrimination- Disability and Religion.

I've been looking on the Consumer Action Group.and etclaims.co.uk, but can't find any hard and fast guidelines to stick to. It's been so difficult doing this and I don't want to mess it up at the last minute...

A few CABs do have more specialist employment advisers. particularly if it is a discrimination issue they should be able to identify some local pro bono workers e.g. A local disability rights organisation.Sometimes the local uni if it has a law course may have a pro bono unit which gives the students experience of running tribunal cases. Do you have a law centre near you.I know some have closed recently because of funding. . I assume that you have already checked your house contents insurance for any legal expenses insurance that has been thrown in as an extra. Check other Insurances and professional memberships as they may have legal expenses thrown in. If you are definitely on your own then getting along to the uni library in the evenings /weekends will be your only option. Have you phoned ACAS? They will try to negotiate a settlement even at this stage if you want to consider this as an option. Go to the Central London Law Centre website I think there are useful documents there about attending a tribunal. Also you said your claim included religious discrimination. Have you contacted the governing body? of your religion, they may be able to help you or fund some legal expenses for a solicitor?

Just checked the etclaims.co.uk website mentioned above and most of what I have said in the above post is on there so you may have considered all these options already. The book Employment Tribunals Remedies by Korn and Sethi has some very good reviews on Amazon, it costs over £60 so a trip to the library will be needed, it will cover how to do schedule of losses for different claims, read the reviews on it. Also I expect by now that you are very familiar with Employment Tribunal Claims tactics and precedents by Cunningham and Reid and this will have some advice on schedule of losses. Just had another thought, even if your union will not progress your case I have heard of retired union reps who sometimes will take on a case for the intellectual challenge. Not sure how you could identify someone like this in your field. Be careful -read up on the situations when costs could be awarded against you.

I live in the middle of nowhere, so a Law Centre is hours away, and I don't have transport to get there, getting to the tribunal has also been difficult and costly. Have already been in for 2 weeks, but then it was adjourned. This makes a lot of things difficult, I am not near a major city where tbh I could probably find a lot of this stuff, and with the length of time this has gone on and the problems it has caused (I'm still not working and unlikely to be in the near future), it makes it financially impossible to get to lots of things.

@zebrafinch- my religion is an unusual one, which doesn't really have a governing body....
Have also been through all insurances, my membership of professional bodies has lapsed because my ex-employers didn't renew it during my suspension...

My other difficulty has been my health (worsened by all of this), I'm not always well enough to go and make a long hike on public transport to the library to do all this, so I have been doing a lot of it at home via the net around my health issues.

I'm also struggling because I can't tell you too much as there have been issues around confidentiality and I don't want to run the risk of breaking any rules either

I just have to cross my fingers, do what I can, and hope for the best!
