Advice Needed - Bank Holidays Whilst On Maternity Leave

Hi everyone

Need some advice on bank holidays whilst on maternity leave.

Here is my situation:

Our holidays run from January - December.

We get paid for the following 29 days:

8 - Bank Holidays:
2 x Easter
2 x May Days
2 x Christmas
2 x New Year

21 floating days

From January until now I have used 10 x floating days and 4 x bank holidays which means I have 11 x floating days and 4 x bank holidays left.

I brought this up the other day as I thought I only had 5 days left so asked if I could use these 1 x holiday per week until I finish up which he said was fine.

However, when I checked the board this morning I saw I forgot to include the Christmas/New Year holidays which means I still have 6 x floating days and 4 x public holidays left.

Rather than stopping an extra 2 weeks early by using my 10 days I have left, I asked if I could carry them on to next years maternity leave so I wouldn't start back until 3rd June instead of 20th May.

As I thought, my employer started questioning all of this and came up with the theory that I'm not entitled to public holidays whilst I'm on maternity leave as these are days that can't be changed (xmas, new year etc) so I'm only owed my 6 x floating days.

The problem with this is that I'm not sure if I use my 6 days next year, will i get paid at my normal full time rate or as part time rate which would mean I would loose out.

Any advice will be greatly appreciated!

have a look at this thread especially the helpful advice from flowerybeanbag.

In summary you should get paid bank hols - either as paid days during your mat leave, or as accrued holiday at the end of your mat leave.
