Work reneging on agreement to pay childcare during SML

So a year ago, after excellent advice on here, I established that dd's place in the company nursery, paid for by salary sacrifice, was a non-cash benefit and hence should not be deducted from my SMP.

However they now claim that they'll only continue payments for people on the childcare voucher scheme, not people who pay the whole fees by salary sacrifice.

Have they got a leg to stand on?
Have I?
Expert opinions welcome...

Nope. Same applies. If you have a letter saying that you'll lose x amount if you use the creche then its the same.
