TransLucent are fundraising for a Judicial Review of the EHRC code of practice for services.

I posted a link to the Cr*wdJustice page but the thread got reserved by Mumsnet moderation function which I thought was odd until I realized that you're not allowed to link to fundraisers.

In any event, perhaps we should contribute.

The other thread was indeed pfft'ed. It's a tongue in cheek suggestion to contribute, but there are still some people who are convinced that the code of practice doesn't meet the statutory requirements or doesn't correctly describe the law; perhaps a JR will help. And then again, probably it won't.

They are going to try to relitigate the two paragraphs ('TW inclusion may be direct discrimination against men: lack of single-sex provision may be indirect discrimination against women') that were already given the ok in the previous JR of the Interim Update?

Oh well, at least they may actually have standing....

The guidance cannot say anything other than the law.

If the guidance is overturned/kicked into the long grass/tantrummed about for the rest of the decade the law still remains the bloody law.

Ffs, can we get Mr Tumble to do a song about it with nice signs and very short words? A social story?

There’s also a whole lot of legislation and regulations that is nonsensical if you let single sex spaces become mixed sex. There’s hundreds of pages of documents that would have to be rewritten. It would take years.

The problem with the internet is that everyone on it can look like an adult. In years gone by this kind of thing would have been written in wax crayon and we would all have known what to do with it.

There are strong grounds for requiring anyone who wants to use anything other than Comic Sans to have cleared some fairly high hurdles.

I sort of love the notion of a Scot "living in exile in Ireland". Presumably he can't cope with not having absolute access to women's single sex spaces and has had to flee the country as a result?

A reminder.

The EHRC can not change the law.
It can only tell you what the law is. This is its job.
The guidance merely tells you how to follow the existing law.
The EHRC could give completely wrong guidance to please activists. But this is meaningless, if someone then takes a case to court and the court goes "well the guidance is bullshit and doesn't reflect the law" and then imposes sanctions accordingly.
The EHRC is not there to make people happy. It is just there to tell you what the law is.
