The EA refers to sex as biological sex, and an NB person may be either biologically male or biologically female, and only the latter can be treated as women under the terms of the EA.
I feel like adding 'Duh!' and a 🙄but that would be simplistic and immature😏

I'm really looking forward to seeing how the union argues otherwise.

Essentially, they are saying that if somebody says they are non-binary, they are allowed into either sex class

Well exactly there is no legal definition of non-binary because non-binary doesn’t exist. It’s just an identity.

I've heard people in union contexts using the phrase "women and non-binary", by which they seem to mean the old Green Party formula of "self-identified non-men".

I don't know where transmen fit into this, but as usual nobody seems particularly bothered about them.

Good to see this.

I’ve seen women advertise for carers for themselves with the role being open to women and non-binary people. I’d be interested to know whether they’d actually want a non-binary identifying male doing the job.

I wish any women taking a Union to court all the luck in the world. It's time someone turned their attention to the unions.
