"Darlington Nurses" vs County Durham and Darlington NHS Trust Tribunal Thread

Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, “Rose”, who:

  • identifies as female
  • has not undergone any physical or hormonal transition and has full male genitalia
  • has cited inclusivity policies
  • is backed by the trust’s HR department
  • has been granted access to a single-sex changing room for women.

The NHS trust’s HR department dismissed the nurses’ concerns, stating they should “broaden their mindset” and “be educated”. More details can be found at Sex Matters

The hearing is due to start on October 20th and is scheduled to last 3 weeks. To view the hearing online email: [email protected] [[email protected]] requesting remote access to the case of 2501192/2024 Hutchinson and others Vs County Durham and Darlington NHS Trust, starting 20th October. Also include your full name and your role in the hearing (eg member of the public or observer). Note, it is likely you will need the same full name and email address to log into the hearing, and the name will be visible to other observers.

The hearing will be live tweeted by https://x.com/tribunaltweets. An alternative to Twitter is to use Nitter: nitter.net/tribunaltweets or nitter.poast.org/tribunaltweets. Tribunal Tweets have more background to this case on their substack, including links to their coverage of the earlier hearings.

In earlier hearings reported at http://archive.today/nh5v9, the claimants were supported by the Christian Legal Centre and represented by Pavel Stroilov (solicitor) and Bruno Quentaville (barrister). The respondents were represented by Simon Cheetham KC. We do not know yet if the same representation will be in place for the October hearing

Horrendous that these women have to take it this far but I also think they were determined to have their day in court and get sunlight on the issue

As the live part of the proceedings are approaching, may I suggest that we take the same approach to posting court proceedings as we did during the Peggie hearing? At least until we get a feel for how the online access is going, how strictly it’s being clerked, potential for disruptions etc

By this I mean, if online observers see/hear something that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Live reporting is usually restricted to people with permission like Tribunal Tweets and the press.

I was at The Battle of Ideas this weekend in London and I went to a couple of talks which were GC. One was about the book Terf Island, which was so uplifting, a real celebration of our wins. In it, one of the speakers , a young woman talked about how grateful she was to all the older women who had done so much work that had enabled her to have the right to be able to express her views on this. One thing she said was that someone , ( I can't remember who ), had said to her, there's not many times in life when you KNOW you're 100% right about something, but this is one of them. The Darlington nurses have truth and reality on their side ( and the actual LAW this time! )

So just why is this a court case? I hope there's lots of reporters there. I think the public are so sick of this now, hopefully it's another nail in the coffin for this utter nonsense.

Fundamentally I think that so many people with influence have made a past commitment to gender ideology that they're not going to break ranks while their similar committed fellows are also holding back.

Which means the solution is to make it "costly" to make further commitments to the ideology and then wait a long slow time for people to back away from it.

I have the day off today (the weather has scuppered my plans of hedge cutting, oh dear) and so I'm using the PC. I've previously managed fine using the normal browser on my phone without the need of any app and so tomorrow and the next days I'll just continue to use that. Although it seems it doesn't work for some people on phones, so it all seems a bit janky.

"It comes as nurse and committed Christian Jennifer Melle, 40, faces being struck off after “misgendering” a convicted sex offender. Ms Melle was disciplined after Patient X, who was born male but identifies as a woman, was taken to St Helier Hospital in Carshalton, Surrey, from a male prison for treatment for a urinary condition. She was called a [n word] multiple times after the inmate overheard her using biologically accurate pronouns during a phone call with a senior doctor."
