Greater Manchester has one of the highest urban recycling rates in the UK. We know loads of residents are doing a great job. But we think we can do even better.

You have to plough through a lot of nonsense to get to the "how do you describe your gender" nonsense.

how do you describe your gender

  • a man (including trans man)
  • a woman (including trans woman)
  • Non-binary
  • In another way
  • Prefer not to say

There was an opportunity to tell them something if you clicked the "in another way" so I did.

This survey falls foul of both GDPR and UK Statistics Authority guidance. Hopefully some kind hearted residents will point this out to them and they will pull it immediately, correct it and then reissue it!

I do not have a "gender". I am a woman as per the definition in the Equality Act.

GDPR specifies that collecting personal data must at be limited to what is necessary for the specified purpose. Why is ‘gender’ information needed in relation to recycling? They should provide information detailing why and how asking for this information is necessary to their aims.

They could have in mind their public sector equality duty (PSED). Whilst I can’t fathom how or why, they may have grounds to think that there are equality issues relating to protected characteristics that could need attending to and collecting this information will help them address these.

If their intent is based on PSED they are going against government guidance produced by the UK Statistics Authority which states that data collected about sex and gender identity should accompanied by clear definitions of the terms and questions about sex and gender identity should be separated.

Their use of ‘gender’ is problematic. If they comply with the guidance they should use ‘gender identity’ and/or sex and provide corresponding definitions. Their use of ‘man including trans man’ without defining those terms furthers the clarity issue as what is meant by ‘gender’.

Brainworm the PSED basis should checking participation in the survey?
To see if their replies are a reasonable representation of the PC in the population.

149 Public sector equality duty
(3)Having due regard to the need to advance equality of opportunity between persons who share a relevant protected characteristic and persons who do not share it involves having due regard, in particular, to the need to—
(a)remove or minimise disadvantages suffered by persons who share a relevant protected characteristic that are connected to that characteristic;
(b)take steps to meet the needs of persons who share a relevant protected characteristic that are different from the needs of persons who do not share it;

I did a rough analyais of a City of Wolverhampton Council survey on this thread.
