Hello - my partner has been giving updates on this but they are rather busy and burnt out so I am using my account to update you all. All the great ideas and support can from mumsnet suggestions - thanks so much.

If you are new to this, all secondary schools in Brighton have made their changing rooms mixed sex and not told either parents or children. What's happening:

FOI Request 1 - details on the liability insurers of the school - received

FOI Request 2 (sent same day)
"Copies of all risk assessments undertaken by the school since 1 January 2021 regarding the decision to allow or potentially allow any pupil to access toilet or changing facilities that do not correspond to their biological sex."
Not received. FOI coordinator at school said this request is:

"The status of the request is ‘completed’."

However, no information on that FOI request has been received here.

The second FOI has been followed up on today to ask what is happening.


Insurers details. The insurer will be written to - but not without feedback and ideas from you all about what to include.

Points to include we believe (please suggest more)

  • the insurer has a legal responsibility to act if they are informed their customer is not complying
  • The insurer may be exposed to secondary liability if they continue
  • That the insurer should investigate the school
  • That measurable harm is happening to girls at the school right now, and therefore the insurer could be called upon to act in someway on the liability insurance

Basically - that their policy is unlikely to be valid.

Would be great to get the letter out ASAP as of course, summer holidays are approaching.

No other updates have been received from the school. Last email from head was 3rd June.

Legal position: waiting to speak to a judicial review solicitor

That question could have been better worded with words to thr effect of "that you are aware of...". Because by law, they cannot mandate trans or trans questioning children disclose. So they cannot possibly answer how many there are.

Anyway, I came to find the thread on the basis of the Times article today "Ban trans women from single-sex spaces, equality watchdog to say" suggesting EHRC guidelines will, as we all know, insist that the law is followed. Due to be released 18th August I believe.

The next stalling tactic this school will use is the fact that KCSiE won't be fully updated with meaningful direction on this until Sept 2026. There is a 2025 KCSiE update due (delayed because of this consultation), but DfE have said it won't be making any substantial operational changes in this late release. Hopefully it will include a simple line that the law must be followed tho.

I have rather taken my foot off the gas due to schools being out for so long, but I will be back on this with a vengeance and if the school does not comply post August 18th, I'll start naming and shaming them...

As in do they use the trans toolkit?

Yes I am 95% certain that they do. a quick FOI request will answer that- you should ask!
