It seems to be down to lack of evidence on whether Merager (who already had a number of convictions including indecent exposure) had the intent of sexual gratification. Merager plans to continue to use the women’s side of Spa facilities.

It is lawful to self-ID into women's facilities in California and have your penis on show as long as you don't have an erection. Blimey!
ETA I have seen a flasher meet those criteria so what is that about?

Sounds like the case for the prosecution wasn't well made but with self ID as the law it was almost impossible...
