It's only because the BBC don't know what to do in this case. Normally they hide behind "We use the pronouns used by the police and court" when faced with complaints about referring to biologically male offenders as "she" (or occasionally "they").
But as the Telegraph reports "Despite court records referring to the paedophile using “he”, police have since referred to McCullgh as “she”."
