NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #14

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although once it was in to the second week it was looking like this would not happen. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently, as a result of a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

One thing I'm picking up from this was the foolish stance NHS Fife took over DU's evidence (he took contemporaneous notes at time of observations) so his recollection was taken as more accurate & reliable because SP hadn't any notes to back her up & likely struggled to clearly recollect innocuous incidents. They never tested any of his claims & NC is doing the job now the NHS - an unbiased one trying to do a reasonable job investigating serious allegations- should have done in the 1st place.

Taking anything a bloke who lies to himself & expects everyone else around him to 'role play' their belief in his lie, as a reliable narrator is a fools errand.

Judge seems to be getting annoyed at length of time but should he not be more in control of the courtroom? The delays are due to missing paperwork, constant interruptions and gaslighting answers by DU.

His non immediate reporting of that could be seen as negligent ( if it actually occured in the way he suggested it had)

A lurker here, so grateful for the updates from the tribunal.

If the tribunal is adjourned for let's say a few months, would SP continue to be paid whilst on suspension? I presume so, but I don't know. Forgive my ignorance.
